Notification according to section 26 para. 1 WpHG

UBS AG, Zürich, Switzerland, notified us on 14 June 2012 pursuant to section 25 WpHG and section 25a WpHG of the following:

1) UBS AG, Zürich, Switzerland, notified us pursuant to section 25 WpHG of the following:

On 8 June 2012, UBS AG exceeded the threshold of 10% of the voting rights of RHÖN-KLINIKUM AG, Schlossplatz 1, 97616 Bad Neustadt a. d. Saale, Germany. On that date, UBS AG held 10.08% of the voting rights in RHÖN-KLINIKUM AG (equals 13,928,208 voting rights).

From these voting rights a proportion of 8.65% (equals 11,951,796 voting rights) is based on voting rights pursuant to sections 21, 22 WpHG and a proportion of 1.43% (equals 1,976,412 voting rights) is based on (financial/other) instruments pursuant to section 25 WpHG. From the voting rights based on instruments pursuant to section 25 WpHG a proportion of 0.00% (equals 0 voting rights) is held indirectly.

2) UBS AG, Zürich, Switzerland, notified us pursuant to section 25a WpHG of the following:

On 8 June 2012, UBS AG exceeded the threshold of 15% of the voting rights of RHÖN-KLINIKUM AG, Schlossplatz 1, 97616 Bad Neustadt a. d. Saale, Germany. On that date, UBS AG held 16.23% of the voting rights in RHÖN-KLINIKUM AG (equals 22,428,208 voting rights).

From these voting rights a proportion of 6.15% (equals 8,500,000 voting rights) is based on (financial/other) instruments pursuant to section 25a WpHG. From these voting rights based on instruments pursuant to section 25a WpHG a proportion of 0.00% (equals 0 voting rights) is held indirectly.

In addition, a proportion of 1.43% (equals 1,976,412 voting rights) is based on (financial/other) instruments pursuant to section 25 WpHG. From these voting rights based on instruments pursuant to section 25 WpHG a proportion of 0.00% (equals 0 voting rights) is held indirectly.

In addition, a proportion of 8.65% (equals 11,951,796 voting rights) is based on voting rights pursuant to sections 21, 22 WpHG.

The (financial/other) instruments pursuant to section 25a WpHG are described as follows:
- „Equity Swaps“ (maturity “at any time”, expiration date 18 June 2012),
- „Equity Swaps“ (maturity “at any time”, expiration date 26 June 2012),
- „Equity Swaps“ (maturity “at any time”, expiration date 20 June 2012),
- „Cash Settled Futures“ (maturity “at any time”, expiration date 20 July 2012).

3) UBS AG, Zürich, Switzerland, notified us pursuant to section 25 WpHG of the following:

On 11 June 2012, UBS AG fell below the threshold of 10% of the voting rights of RHÖN-KLINIKUM AG, Schlossplatz 1, 97616 Bad Neustadt a. d. Saale, Germany. On that date, UBS AG held 9.56% of the voting rights in RHÖN-KLINIKUM AG (equals 13,213,275 voting rights).

From these voting rights a proportion of 8.59% (equals 11,874,250 voting rights) is based on voting rights pursuant to sections 21, 22 WpHG and a proportion of 0.97% (equals 1,339,025 voting rights) is based on (financial/other) instruments pursuant to section 25 WpHG. From the voting rights based on instruments pursuant to section 25 WpHG a proportion of 0.00% (equals 0 voting rights) is held indirectly.
